Not that much new for 2026! Phew! Most legislation happened during the "long session" in 2025. With many laws coming into effect mid-season. Here is a rundown:
- Washington’s minimum wage will rise to $17.13 an hour on Jan.1, 2026. That’s 2.8 percent higher than the $16.66 an hour minimum wage in 2025.
- Temporary Worker Housing Fees have gone up. You can see the details on the adopted rulemaking document. Page 30.
- Personnel file copies need to be provided to employees (this started mid-2025). Harvust makes that easy, you all have nothing to worry about there.
- Mini WARN Act still is an administrative headache, no new clarity on applicability for ag businesses. Maybe in 2026 legislative session🤞
- A new I-9 audit notice to employees might become law, but would be, as Enrique at WAFLA puts, it "an administrative landmine". Something to watch out for 👀 If it becomes law, we'll have a notice for you to use in the Harvust document library.
- Workers comp premiums are going up ~4.9% on average. We helped one of our growers lower their WA workers comp rate 40% in two years. This is one of the biggest ROI opportunities for you farm with Harvust's safety tools.
- No reform on ag overtime 😞
